Condition of the driver
Prohibition on Driving While Unfit
Anyone who is drunk, overtired, or otherwise unfit to drive must not operate a vehicle.
Preventing Overtiredness
To prevent overtiredness, it is crucial to take regular breaks of at least every 2-3 hours during longer journeys. These pauses help maintain focus and safety on the road.
Inability to Drive Due to Alcohol
Inability to drive due to alcohol (drunkenness) is considered proven when the driver has a blood alcohol concentration (BAC) of 0.5 or more ppm or an amount of alcohol in the body that results in such a BAC.
However, even smaller amounts of alcohol can result in punishment. It takes about eight hours for 1.0 per mille of alcohol to break down, and driving ability can be impaired at levels as low as 0.2 per mille.
Alcohol and Medication or Drugs
Combining alcohol with medication or drugs can amplify the effects and lead to a further inability to drive.
Entrusting a Vehicle to Unfit Drivers
No one is allowed to entrust a vehicle to a driver who is unfit to drive.
